Effective date: July 26, 2026
These Terms of Service (“Terms”) govern your use of the GimmePhoto mobile app and the gimmephoto.com website (together, the “Service”), operated by GimmePhoto (“GimmePhoto,” “we,” “us,” or “our”). GimmePhoto lets small, invited groups create shared photo “piles.” By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who can use GimmePhoto
You must be at least 13 years old to use the Service. By using it, you represent that you meet this requirement and that the information you provide is accurate.
2. Your account
You are responsible for keeping your account credentials secure and for all activity that happens under your account. Please notify us promptly if you believe your account has been compromised. You can delete your account at any time from within the app.
3. Your photos and content
You keep ownership of the photos and other content you add to GimmePhoto. By adding content to a pile, you grant us a limited, non-exclusive license to store, process, and display that content for the purpose of operating the Service and showing it to the people you have chosen to share that pile with. You are responsible for the content you add, and you represent that you have the rights to it and the right to share it with the people in your piles.
4. Acceptable use and content policy
GimmePhoto is for sharing your own photos with a small, invited group. It is not a platform for public distribution, and it is not an adult, pornographic, or “not safe for work” service. You agree that you will not upload, share, store, or otherwise use the Service in connection with any content or conduct that:
- is illegal, or promotes, facilitates, or instructs others in illegal activity;
- is, contains, or promotes child sexual abuse material (CSAM), or that sexualizes, exploits, or endangers a minor in any way — this is strictly prohibited and we have zero tolerance for it;
- is sexually explicit or pornographic, or contains nudity;
- depicts or promotes violence, graphic gore, self-harm, or cruelty;
- is hateful, harassing, bullying, threatening, or abusive toward any person or group;
- infringes anyone’s intellectual property, privacy, or other rights, including sharing photos of other people without a reasonable basis to do so;
- contains malware or spam, or attempts to disrupt, overload, reverse-engineer, scrape, or gain unauthorized access to the Service or to other users’ accounts or content.
5. Reporting, and consequences of violations
If you encounter content or behavior on the Service that violates these Terms, please report it to us at [email protected]. We may review reported content and, at our discretion and with or without notice, remove any content and suspend or permanently terminate any account that violates these Terms.
We cooperate with law enforcement. We report apparent child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC) and/or the appropriate authorities as required by law. Serious or repeated violations may result in removal of your content, loss of access to the Service, and referral to law enforcement. You are solely responsible for content you upload and for any consequences of violating these Terms or the law.
6. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination (such as ownership, disclaimers, and limitations of liability) will survive.
7. Disclaimers
The Service is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that content will always be available. Please keep your own copies of photos that matter to you.
8. Limitation of liability
To the fullest extent permitted by law, GimmePhoto will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data or content, arising out of or relating to your use of the Service.
9. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Effective date” above and post the updated Terms here. Your continued use of the Service after changes take effect means you accept the updated Terms.
10. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules.
